Official Rules and Terms

READ THESE RULES BEFORE ENTERING. Participation constitutes your full and unconditional agreement to these Official Rules, including but not limited to, the consent to receive communications related to this Promotion, a class action waiver and jury trial waiver, and mandatory arbitration provisions herein.

ELIGIBILITY: This Calculator Sweepstakes (the "Promotion") is open to legal residents of the fifty (50) United States and D.C., aged 18 years or  age of majority in their state or jurisdiction of residence, whichever is older, at the time of entry. Void where prohibited or restricted by law. Subject to all applicable federal, state, and local laws. Employees of Casio America, Inc. ("Sponsor"), its affiliates, subsidiaries, and advertising and promotion agencies, and each of their immediate family members (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related,  are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this Promotion.

PROMOTION PERIOD: Promotion begins July 1, 2024 at 12:00 a.m. (Eastern Time) through September 30, 2024 at 11:59 p.m. (Eastern Time) (the "Promotion Period"). Sponsor's computer is the official time keeping device for this Promotion.

HOW TO ENTER: During the Promotion Period, sign up for the Casio Education eNewsletter with at least the required fields "First Name", “Email”, and "State" pursuant to the onscreen instructions and submit your information to receive one (1) entry. Limit one entry per person and per email address throughout the Promotion Period. Entries received from any person or email address more than the stated limitation will be void. Entries generated by any means which subvert the entry process are void. Entries become the property of the Sponsor and will not be acknowledged. Proof of submission does not constitute proof of receipt. Entrants must have a valid email address and it is the entrant's responsibility to update the Sponsor of any change in email address.

ALTERNATIVE METHOD OF ENTRY: To enter without a digital signup, send a letter with your name and return mailing address to receive one (1) entry. There is a limit of one entry per person. Entries via this method are exclusive and cannot be combined with digital signups. Address your letter to: Casio EdTech c/o Dave Shaw, 570 Mount Pleasant Avenue, Dover, NJ 07801. Names and addresses will be securely shredded at the conclusion of the Promotion. Proof of submission does not constitute proof of receipt. Entries become the property of the Sponsor and will not be acknowledged. Limit one entry per person regardless of method of entry.

CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS' FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

RANDOM DRAWINGS & WINNER NOTIFICATION: Four (4) potential winners will be selected in a random drawing held after the close of the Promotion Period. Odds of winning depend on the number of eligible entries received. Winners do not need to be present to win but must acknowledge notification in the manner specified herein. Potential Prize winners may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, publicity release within fourteen (14) days of date of notification of winning. If such documents are not received by the Sponsor within the specified time period, and in the manner specified by the Sponsor, if the Sponsor is unable to contact a potential winner, or a potential winner is not in compliance with these Official Rules, the Prize will be forfeited and, at the Sponsor's discretion, an alternate winner may be selected for the applicable drawing. Prize awards are subject to verification of eligibility and validation of compliance with these Official Rules. No more than the number of prizes stated herein will be awarded. If, for whatever reason, the Sponsor receives more valid prize claims for any drawing than the number of prizes stated herein, the Sponsor may, in its sole discretion, award the stated number of prizes at issue to among all non-suspect, eligible claims received for such a prize.

PRIZES: Four (4) total winners will each receive one (1) fx-9750GIII graphing calculator with an approximate retail value ("ARV") of sixty-five dollars ($65.00) each (the "Prize" and together, the "Prizes"). Prizes are awarded "as is'' with no warranty or guarantee, either express or implied by the Sponsor. Prizes are not transferable or redeemable for cash or greater value. The Sponsor reserves the right, in its sole discretion, to substitute prizes (or portions thereof) with one of comparable value. All federal, state, and local taxes, if any, as well as any other costs and expenses associated with the acceptance and use of the Prize not specified herein as being awarded are the sole responsibility of each individual winner. All Prize details are in the Sponsor's sole discretion. Unclaimed Prizes will not be awarded. Total ARV: $260.00.

GENERAL CONDITIONS: Released Parties (as defined below) are not responsible for lost, late, incomplete, stolen, inaccurate, misdirected, damaged, delayed, garbled, incorrect, or undelivered entries; or other errors of any kind whether human, printing, typographical, or otherwise relating to or in connection with this Promotion, including, without limitation, errors which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the Prizes, the cancellation or postponement of the Promotion, or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by any equipment or programming associated with or utilized in the Promotion or otherwise. Persons who tamper with or abuse any aspect of the Promotion or who are otherwise in violation of these Official Rules, as solely determined by the Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Promotion be unable to run as planned for any reason, including if, in the Sponsor's sole opinion, the Promotion is compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, the Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Promotion, and, if terminated, select the potential winners for the random drawing(s) at issue from all eligible, non-suspect entries received for the applicable drawing(s)prior to action taken. Entrants, by participating, agree that the Sponsor, and its respective parents, affiliates, subsidiaries, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties'') will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses, or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a Prize or participation in this Promotion. By acceptance of Prize, except where legally prohibited, winner grants permission for the Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide, and on the Internet and world wide web, in perpetuity, without notice or review or approval.

LIMITATIONS: All entries must be fully and accurately completed and in compliance with these Official Rules. Use of any automated system to participate in the Promotion or subvert the entry process is prohibited and will result in disqualification and all associated entries will be void. Sponsor and all Released Parties are not responsible for incomplete, inaccurate, illegible, unintelligible, damaged, lost, late, postage-due, misdirected, delayed, garbled, or stolen entries or for failure to receive entries during the Promotion Period due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of a Prize or in any Promotion-related materials. In the event of a dispute of who submitted an online entry, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent and he/she must comply with these Official Rules. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Promotion. All entries become the property of Sponsor and will not be acknowledged or returned.

PRIVACY POLICY: Sponsor processes information that identifies or is linked to an individual Entrant (“Personal Information”) about Entrants in order to administer the Promotion pursuant to these Official Rules and to comply with legal obligations, consistent with Sponsor’s privacy policy. Personal Information collected includes first name, last name, state of residence, and email and/or mailing address. Sponsor shall retain Personal Information for as long as necessary for the purpose(s) the Personal Information was collected and consistent with its privacy policy. DISPUTES: This Promotion is governed by, and shall be construed in accordance with, the laws of the State of New Jersey, without regard to its conflict or choice of law provisions. If any dispute, controversy, claim, or loss cannot otherwise be resolved through direct discussions or voluntary and non-binding mediation, any such disputes, controversies, claims, or losses shall be resolved by FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) and conducted before a single arbitrator pursuant to the applicable Rules and Procedures established by the AAA, including the AAA’s Supplementary Procedures for Consumer-Related Disputes (as applicable) and as amended by these Terms (“Arbitration Rules and Procedures”). The AAA’s Rules, and a form for initiating arbitration proceedings, are available at the AAA’s website located at https://www.adr.org.  ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH SHALL BE CONDUCTED EXCLUSIVELY IN NEW JERSEY. The remedy for any claim SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. Entrants agree that they are hereby WAIVING ANY RIGHT TO A JURY TRIAL. Entrants agree that the rights and obligations of any Entrant and/or the Released Parties and/or any other party SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION. ANY DEMAND FOR ARBITRATION MUST BE FILED WITHIN ONE (1) YEAR FROM THE END OF THE PROMOTION PERIOD, OR THE CAUSE OF ACTION SHALL BE FOREVER BARRED.
